A focused, 4-part introduction to advocacy skills. Open to all second- and third-year law students, the FLI is a hands-on crash course designed to allow students of all experience levels to learn new skills or hone existing ones. Students work directly with Texas Law’s interscholastic mock trial coaches and instructors to focus on skills necessary to communicate effectively as a lawyer as well as successfully compete in a mock trial competition. Even those not interested in competing, but currently enrolled in an advocacy course, may find this program a useful complement to their coursework.

Dr. Paul E. Kerry (BYU) examines the opposition of the Religious Society of Friends to Texas annexation, the Mexican-American War, and the Fugitive Slave Act as a form of legal resistance to the federalization of slavery. His talk places the First Amendment right of petition at the heart of the story, showing how Quakers used memorials, petitions, antislavery newspapers, religious meetings, and public advocacy to challenge congressional suppression under the gag rule and resist federal complicity in slavery’s expansion and enforcement. The paper recovers a neglected chapter in the history of antislavery constitutionalism.

In the Supreme Court’s recent Trump v Barbara opinion on birthright citizenship, Justice Alito’s asserted in his dissent that before and soon after the Civil War “immigration was unrestricted, so aliens could come and stay as long as they wanted.” Historical evidence does not confirm his claim. Though there were few federal laws in that period, a phalanx of state-level laws restricted the international and interstate migration of free and enslaved Black people and indigent migrants. Professor Anna Law, a scholar of US immigration and constitutional history, is the author of a timely new book that addresses these subjects.

Since the U.S. Supreme Court overturned Roe v. Wade, Texas has been home to one of the harshest criminal abortion bans in the country. Yet, there have been virtually no prosecutions under the ban, due in part to the territorial limits of state law, constraints on accomplice liability, and a legislative commitment not to prosecute pregnant persons for their abortions. A focused, 4-part introduction to advocacy skills. Open to all second- and third-year law students, the FLI is a hands-on crash course designed to allow students of all experience levels to learn new skills or hone existing ones. Students work directly with Texas Law’s interscholastic mock trial coaches and instructors to focus on skills necessary to communicate effectively as a lawyer as well as successfully compete in a mock trial competition. Even those not interested in competing, but currently enrolled in an advocacy course, may find this program a useful complement to their coursework.

Join the Strauss Center for International Security and Law and the Clements Center for National Security on Tuesday, September 22, for “The Law of the Sea Treaty at Risk,” with former Secretary of the Navy Donald Winter. The Law of the Sea Treaty was the product of the third UN convention on law of the sea held from 1973 to 1982 with more than 160 states participating. Currently, however, many states, including the US and Iran, still have not ratified the treaty. Furthermore, some states that have ratified the treaty, such as the PRC, blatantly ignore treaty provisions. At a time when maritime commerce represents over 80% of world trade, can the international community let this treaty effectively become irrelevant? Join Secretary Winter as he answers these questions. Lunch will be served.

Biography Dr. Donald C. Winter is an independent consultant supporting national and international security interests in the US and allied nations. He served as the 74th Secretary of the Navy from January 2006 to March 2009. As Secretary of the Navy, he led America’s Navy and Marine Corps Team and was responsible for an annual budget of over $125 billion and almost 900,000 people. Dr. Winter’s prior business career in the aerospace and defense industry spanned over 30 years as a systems engineer, program manager and corporate executive.

From 2009 to 2020, he was a Professor of Practice at the University of Michigan where he taught graduate level courses on systems engineering, satellite design, and maritime policy. He was reappointed to this role in 2024. Since 2011 he has served in multiple roles assisting the Commonwealth of Australia in their efforts to reconstruct the Royal Australian Navy’s fleet and establish a sustainable shipbuilding capability. During 2019 to 2021 he also served as the US DoD’s Senior Defense Industry Advisor for Ukraine. Dr. Winter was elected to the U.S. National Academy of Engineering (NAE) in 2002 and served as its chair from 2020 to 2024.

A focused, 4-part introduction to advocacy skills. Open to all second- and third-year law students, the FLI is a hands-on crash course designed to allow students of all experience levels to learn new skills or hone existing ones. Students work directly with Texas Law’s interscholastic mock trial coaches and instructors to focus on skills necessary to communicate effectively as a lawyer as well as successfully compete in a mock trial competition. Even those not interested in competing, but currently enrolled in an advocacy course, may find this program a useful complement to their coursework.

The 2026 Fall Litigation Institute will be held from 1:00-3:00 p.m. (with lunch provided beginning at 12:30 pm) over four Fridays. You are free to participate in any/all sessions but must SIGN-UP to do so. In the wake of the Supreme Court's decision in Dobbs v. Jackson Women's Health Organization, the United States possesses a fragmented patchwork of state laws imposing varying degrees of restrictions on and penalties for abortion. This talk will examine the profound implications of this arrangement for noncitizen women, whose rights and mobility are already constrained by federal immigration laws and policies. It will argue that the intersection of state-level abortion restrictions and federal immigration enforcement creates de facto internal borders, uniquely curtailing the reproductive freedoms of noncitizens.

Faulty forensic evidence and biased evidence relying on sex-based stereotypes have long been used to convict innocent women in situations where an accident or health event has been misconstrued as a criminal act. This talk will conceptualize and consider “reproductive wrongful convictions,” which are instances in which a noncriminal pregnancy-related event or act––such as a miscarriage, stillbirth, or taking legally prescribed medicine––is erroneously labeled as criminal. It will also attend to the ways that women with disabilities and from racially and economically subordinated communities are often labeled as “unfit” and made particularly vulnerable to these charges.

Using the example of post-Dobbs abortion bans that contain no exceptions for incest or rape, this talk will argue that law and institutions charged with protecting the vulnerable are often responsible for the oppression of women, the suppression of their capacities, and the harms that follow. Healthcare conscientious objection allows providers to refuse treatment based on moral or religious beliefs. Alongside the legalization of abortion since the 1970s, conscience clauses have expanded globally. In response, some legislative bodies and courts have implemented institutional safeguards to ensure that conscience-based refusals do not become insurmountable obstacles for patients.  This talk will argue that while these institutional safeguards hold potential, they have not fundamentally altered the dominant understanding of medical objection, which frames the conflict and its resolution as a situation involving two equally balanced parties.
