DESCRIPTION:<p>The Supreme Court's emergency docket—often called the "shadow docket"—has put the Court between a rock and a hard place. In ruling on an emergency application, the Court can either write nothing and leave its decision unexplained, or it can write an opinion and lock its underdeveloped views in as binding precedent. Tyler Dobbs (Consovoy McCarthy) joins us to explore how a procedure already used by lower courts could offer the Court a solution, bringing clarity and accountability to one of the Court's most controversial practices.</p>
