Description

Products Liability will cover the special category of tort cases involving injury from defective products. We study the three bases of liability applicable in such cases with emphasis on strict products liability. We will also explore the practical litigation aspects of preparing the cases, from all perspectives, as well the importance of expert testimony. The course will also include coverage of special types of products liability cases such as those involving drugs and medical devices and, if time permits, mass tort litigation. You will be evaluated on the basis of a written final examination. We will also cover a variety of problems that may include written assignments. We will be using Owen, Montgomery and Davis, Products Liability and Safety: Cases and Materials (5th ed. 2007).
