Description
This course examines a variety of methods used to resolve disputes outside the traditional litigation process. Both in the United States and abroad, alternative dispute resolution (ADR) processes have become commonplace, and the vast majority of disputes filed in courts in this country are resolved short of trial. This ADR survey course focuses on negotiation, mediation, arbitration, collaborative lawyering, and other processes for dispute resolution. We examine adjudicative, evaluative, and facilitative models, with emphasis on statutory and other sources of ADR processes and rules. We also deal with effective advocacy in ADR processes. Through limited use of simulations, students also experience ADR processes as participants. This course provides a broad foundation in alternative dispute resolution for students from whom this class constitutes their only exposure to the field and also for students who go on to take specialized ADR courses like Negotiation, Mediation, and Arbitration. It is open to all Law students as well as to graduate students in other disciplines. This course is approved by the interdisciplinary Portfolio Program in Dispute Resolution as meeting the requirement for a course in basic conflict or dispute resolution theory.Instructors
