Description

This course will look at the way the law promotes innovation, with an emphasis on the potentially complementary and conflicting roles of antitrust law and intellectual property law. Innovation is critical to economic growth. Consequentially, both antitrust and intellectual property regimes can have profoundly positive or negative effects on economic growth and consumer welfare. The central issue animating the course is whether antitrust enforcement is achieving its goal of encouraging innovation and consumer welfare, failing this mission by deterring pro-competitive conduct, or under- enforced and overly deferential to the intellectual property laws. As such, this course is more of an advanced antitrust course than an advanced intellectual property class.
