Description

Alternative Dispute Resolution (ADR) is a course about a variety of methods used to resolve disputes outside of the traditional litigation process. This course is designed to provide an overview of the negotiation, mediation and arbitration processes and the law that governs them. The course is an academic law course, not a practice or "skills" course. Consequently, then, there will be no simulation exercises in this course. We will cover negotiation, mediation, arbitration, collaborative lawyering and other processes to resolve disputes. The vast majority of disputes in this country are resolved without resort to litigation, and the overwhelming majority of those disputes that are filed are resolved before trial or the conclusion thereof. In this country and abroad, ADR processes have become commonplace in resolving disputes. We will examine adjudicative, evaluative, and facilitative models as well as the sources of ADR methods and rules. Additional courses in mediation, arbitration and negotiation, that may include simulated exercises, could well follow this building block course for those with further interests.
