Description
This course considers environmental legislation in Brazil and the U.S., focusing on four significant cases of environmental conflict (two from each country), and analyzing the role of the law in their resolution. We will also analyze alternative forms of conflict resolution, such as mediation and the "Adjustment of Conduct" provided for in Brazilian law, as well as the role of prosecutors in each country. We will use the case studies as a way of addressing the fundamental conflict between the principles of free enterprise, economic development and environmental considerations. Finally, we will engage in an analysis of the effectiveness of criminal and civil systems in ensuring compliance with environmental regulations.Instructors
