Description
The course gives a detailed analysis of the role of insurance in litigation, and consumers' rights and remedies in insurance disputes. We will focus on practical applications of substantive law, covering: insurance coverage; actionable conduct; statutory and common law theories; standing; persons and entities that may be liable; remedies; defenses; pre-suit considerations; pleadings; discovery; trial tactics; and ethics. We discuss the politics and philosophy of the tort system and the interplay of insurance. We learn about effective advocacy -- how to problem solve for clients and advocate in trial, mediation, and appeal. Woven through the course are issues of insurance law, contract analysis, tort law, statutory remedies, ethics, client relations, pretrial procedure, trial advocacy, and strategy.Textbooks ( * denotes required )
