Description
The course will be a study of some of the central questions in the philosophy of law: What is the nature of law? What distinguishes law from mere coercion on the one hand and morality on the other? What place if any does morality have in a legal system? Do moral norms or principles influence or constrain judges' legal decisions? Should they? Readings for the course will be drawn from the writings of Aquinas, Bentham, Austin, Hart, Dworkin, and some more recent contributions to the philosophy of law. No previous study of philosophy will be required or assumed.Instructors
