Description

This course will consider key aspects of modern housing and planning law and the ways in which they affect spatial dynamics and the real estate market. Topics - drawn from the fields of land use law, landlord-tenant law, and housing finance - will include zoning, eminent domain and economic development, subsidies to ownership, lending and foreclosure laws, the Fair Housing Act, the warranty of habitability, and homeowners associations. In addition to exploring the relevant legal doctrine, we will situate the policies within the broader context of historical and contemporary trends (up to and including the current credit crisis) in American housing markets. We will thus examine suburban sprawl, urban decline and revitalization, neighborhood change (such as gentrification), availability of affordable housing, access to credit, housing discrimination, and the role of local government. In accordance with the interdisciplinary mode of analysis, readings will consist not only of legal materials, but also of works from the disciplines of architecture and urban studies.
