Description
We will explore the reasons for, and operation of, administrative agencies. This will start with an exploration of the public interest justifications for regulation, including natural monopoly, externalities, information failures, unequal bargaining power, paternalism, and others. We will also learn about the reasons for "regulatory failure," including the self-interested behavior of regulated entities, interest groups, politicians, and regulators. Next, we will explore the various remedies for regulatory failure, including Cost Benefit Analysis, increased control of the process by the President, and judicial application of Administrative Law. The Administrative Law section includes portions on separation of powers, judicial review of the substance of an agency's decision, and judicial review of the procedures used by the agency.Instructors
