Description
This course will consider mediation from the perspective of both the mediator and the legal advocate in the mediation process. Because the vast majority of cases settle prior to trial, attorneys today need to be prepared to effectively represent their client in a variety of settings outside the courtroom, including negotiation and mediation. Students will study mediation models, current laws regulating and guiding mediation, ethical considerations for mediators and advocates, client relations, and broader applications of mediation skills to lawyers. Through simulations and reflective journals, students will hone the skills necessary to prepare their clients for mediation, be an effective advocate during mediation, understand the role of mediator, and seek sustainable solutions.
If students are interested in fulfilling the requirements to become a qualified court-appointed mediator in Texas, extra opportunities will be made available.
