ADR Legislation

To encourage the use of ADR in state agencies, the Sunset Advisory Commission, with the Center’s support, adopted a new across-the-board (ATB) recommendation that directs each agency subject to Sunset to adopt policies and procedures for the use of ADR, to designate an ADR point person within the agency, and to provide measurement and evaluation of ADR usage.

Is your agency or association ready to draft an ADR policy or rule and is looking for some guidance?  Then, a good place to start is with the "Guidelines for the Use of Alternative Dispute Resolution by Texas State Agencies" prepared by the State Office of Administrative Hearings (SOAH).  The guidelines include: definitions of ADR terms, directions for Dispute Resolution Coordinators, and how and where ADR processes are currently used in state government.  Also, since 2002, state agencies acquiring ADR language through the Sunset process are directed to conform their ADR procedures, to the extent possible, with SOAH's model ADR guidelines.
