Description

Thanks to our heritage of Spanish law, from the days of the Republic all the way to the 21st Century the Texas Marital Property Regime has been based on the principles of community property, and, of course, its correlative, separate property. This short course introduces these principles, as reflected by age- old case law to the current Texas Family Code, always overseen by the Texas Constitution. The course will meet twice a week for fourteen 50-minute sessions, followed by a seventy-five minute exam. Topics will include: history; characterization; pre- and post-marital agreements; managerial rights and creditors' rights; homestead; and, dissolution of the community estate by death, divorce, annulment or emigration.
