This course examines the collective bargaining model of employee relations and worker participation in management decision-making established by the National Labor Relations Act. The legal framework within which union organizing, collective bargaining, economic pressure tactics, and contract dispute resolution take place is examined, as are the respective roles and relationship of Congress, the courts, the National Labor Relations Board, and private arbitrators. Existing rules are studied in light of their demonstrated or likely impact. This investigation is conducted against the background of the historical and social context within which the collective bargaining model arose and has developed in the U.S. The success of the NLRA as an experiment in the private ordering of employment will be critically assessed. Evaluation will be by examination.
