Description

In this course, we will explore some of the most vital -- and controversial -- topics in current land-use decision-making. These will include green building incentives; private payment for environmental (endangered species) protection; the hottest takings/eminent issues; the sprawl/development debate; and natural disaster response and relief. Our central focus of attention involves the mechanisms and institutions -- some bearing down on the same issues from several directions all at once -- through which governance decisions within areas such as these are being made. The relationships among law and politics; the federal government, states, and localities; and decisional mechanisms that run the gamut of democratic accountability will fall under our gaze. Course materials will be eclectic and will include popular accounts, case studies, scholarly commentary, case law, film, and occasional expert visitors. This course will require short papers in lieu of an exam. The papers will not qualify for satisfaction of the upper-level writing requirement. This course will meet conjointly with "Property and Governance," the upper-level seminar. There are no prerequisites for this course.
