Description
This course is a survey of litigation after the liability determination. Namely, what can a court do fora claimant who has been wronged or is about to be wronged? What can a court do tothe wrongdoer? We will review the principal remedial choices: compensatory and punitive damages, injunctions, declaratory judgments, restitution of defendant’s gains, and the means of enforcing judgments. We will ask what remedies plaintiff can get, how much plaintiff can get, and how to choose among alternative remedies. Intermittently, we will ask whether theories of corrective justice or economic efficiency better explain the remedies available to plaintiffs.
