Professor Mullenix presented a paper, "Nine Lives: The Punitive Damage Class," at a symposium held by the University of Kansas Law School on October 19-20, 2009. The paper was presented as part of a symposium entitled: "Aggregate Litigation Since Ortiz v. Fibreboard," sponsored by the University of Kansas Law Review, which will publish the article. In this paper Professor Mullenix analyzes the enduring phenomenon of the punitive damage class, and the likelihood that controversy over the punitive damage class will eventually be considered by the Supreme Court.
