Biography

LINDA S. MULLENIX holds the Rita and Morris Atlas Chair in Advocacy at the University of Texas School of Law. Professor Mullenix holds M.Phil. and Ph.D. degrees from Columbia University in political science and graduated Phi Beta Kappa, magna cum laude, from the City College of New York. She received her law degree from Georgetown University Law Center and practiced appellate litigation in Washington, D.C. She has held appointments as a Supreme Court Fellow at the Federal Judicial Center; was a scholar-in-residence at the Rockefeller Foundation Bellagio Study and Conference Center in Italy; and also held the Fulbright Senior Distinguished Chair in Law in Trento, Italy. She has been a visiting professor at Harvard and Michigan Law Schools. Professor Mullenix has been a professor since 1974, teaching federal civil procedure, mass tort litigation, current issues in class action litigation, transnational class actions, aggregate and class action litigation in a global context, and state class action procedure. She also has taught complex litigation, federal courts, conflicts, professional responsibility, and civil justice reform.

In January 2012, Professor Mullenix was honored as a “Pathfinder 2012” by the Travis County Women’s Law Association "for her outstanding service to our legal communtiy and continued inspiration as a role model and trailblazer," which recognizes women in the community who “have used their law degrees in ways that inspire the rest of us.” Professor Mullenix was a founding Director and has served on the Board of Directors of the Fulbright Association of Austin. She currently serves as the vice-president of the Fulbright Commission Italian Interest Group.

Professor Mullenix is an elected Life Member of the American Law Institute, serving as the Associate Reporter for the Restatement of the Law Governing Lawyers, a consultative member of the Transnational Rules of Civil Procedure project and the Complex Litigation Project. In addition, Professor Mullenix is an elected Life Fellow of the American Bar Foundation, a Life Member of the Texas Bar Foundation, and an elected member of the International Association of Procedural Law.

Professor Mullenix is the author or co-author of twenty-five books including Public Nuisance: The New Mass Tort Frontier (Cambridge University Press 2024); Leading Cases in Civil Procedure (4th ed. 2023); Mass Tort Litigation (4th ed. 2023); Federal Courts in the Twenty-First Century (3d ed. 2007); State Class Action Practice and Procedure (2000); ALI Restatement Third, The Law Governing Lawyers (2000); Understanding Federal Courts (2d ed. 2015); and Moore's Federal Practice (2d and 3d Eds.). She has contributed nuemrous book chapters and authored several professional reports. For over 30 years, Professor Mullenix has been a contributing writer for Preview of Supreme Court Cases and a regular columnist for the National Law Journal. She has written hundreds of articles published in The Chicago Legal Forum, Cornell Law Review, Georgetown University Law Journal, Harvard Law Review, Michigan Law Review, Minnesota Law Review, Stanford Law Review, University of Pennsylvania Law Review, Northwestern Law Review, Texas Law Review, and Vanderbilt Law Review, as well as numerous other journals. Courts throughout the United States have cited Professor Mullenix's articles on procedure and complex litigation.

Professor Mullenix has broadly served the profession in a number of capacities, including as Reporter for an ABA Task Force on Class Actions; Reporter for the Southern District of Texas, Civil Justice Reform Act; Reporter for the National Conference of Federal-State Judicial Relationships; Advisor, Texas Class Action Rules Subcommittee; and Advisor, National Center for State Courts, Study on Civil Discovery. Professor Mullenix has been an invited participant numerous conferences including the ABA Conference on the Future of Class Action Litigation in America; the Symposium on Cutting Edge Issues in Class Action Litigation, The Legal Forum, University of Chicago; the Class Action Conference, Judicial Conference Committee on Rules of Practice and Procedure; the Gulf States Class Action Symposium; the University of Pennsylvania Symposium: Mass Torts; the ABA Class Action Institute; the Mass Tort Working Group, Judicial Conference Committee on Rules of Practice and Procedure; the Special Study Conference on Federal Rules Governing Attorney Conduct, Judicial Conference Committee on Rules of Practice and Procedure; the Research Conference on Class Actions, Institute for Judicial Administration and N.Y.U.; the Conference on Civil Procedure and the Future of the Federal Rules, Southwest Legal Foundation; and the National Mass Tort Litigation Conference. She has served as a faculty member for the Annual Conference on Complex Litigation and Resolution of Class Action Litigation, and as a senior scholar commentator for the Federal Courts Junior Scholarship Workshop.

Courts throughout the United States have cited Professor Mullenix’s articles on procedure and complex litigation. She has appeared as a radio commentator on National Public Radio and been quoted in The New York Times, the Wall Street Journal, the Los Angeles Times, the National Law Journal, CNNOpinion.com, and the Guardian (U.K.), among other media publications. Professor Mullenix has worked as counsel and as a consulting expert with plaintiffs, defendants, and objectors on numerous prominent federal and state class action cases. She has delivered lectures relating to class action litigation in Austria, Australia, Brazil, Canada, Colombia, Croatia, Germany, Israel, Italy, Luxembourg, The Netherlands, South Africa, Switzerland, and the U.K.

Professor Mullenix has three sons and six grandchildren. She holds dual citizenship with Italy.

She spoke on "Class Action Waivers in Arbitration Agreements: The Twenty-First Century Arbitration Battleground and Implications for the EU Countries." Her conference paper will be published in the Emory Law Journal of International Relations, in Spring 2024.

Professor Mullenix was a participant presenter during the Comparative Procedural Law and Justice Mid-Term Conference, on a joint project for the Max Planck Institute Luxembourg for Procedural Law. She presented her segment of the joint compendium of comparative civil procedural law, to be published by the International Association of Procedural Law in 2024. The conference was attended by project scholars globally from all continents and legal systems.

Professor Mullenix participated in a multi-day workshop on comparative civil procedure, as part of an ongoing book project to be published by Elgar Press (2023) as a Handbook on Comparative Civil Procedure (edited by Prof. Margaret Woo, Northeastern University Law School, and Prof. Remco von Rhee, Prof. of European Legal History and Comparative Civil Procedure at Maastricht University). Professor Mullenix presented her book chapter, Joinder of Parties and Group Litigation in Common Law and Civil Law Jurisdictions, with co-author Prof. Stefaan Voet of Belgium. Conferees at the workshop included scholars from France, Spain, Argentina, South Africa, Italy, China, Belgium, the Netherlands, Germany, Romania, and other countries. The workshop was held at the Chateau Neercanne, Maastricht, The Netherlands. The book will be published in summer-fall 2023.

Invited Panel Speaker

AALS Annual Meeting, San Diego, California

Professor Mullenix was an invited panelist speaker at the AALS Torts and Compensation Systems program at the 2023 annual meeting of the American Association of Law Schools. She was part of the section program entitled: "Opioid Litigation: The Good, the Bad, and the Ugly." The program explored the current state of nationwide opioid litigation and shared views on the success of this litigation as a response to the opioid crisis. Professor Mullenix addressed the question whether aggregation and the leading role of public entity plaintiffs in the Opioid MDL had marginalized individual plaintiffs in their quest for remediation of individual claims. Program speakers included opioid litigation plaintiff's attorney Elizabeth Carbraser, Professor Nora F. Engstron (Stanford University Law School), Charles Lifland (opioid defense attorney, O'Melveny & Myers), Professor Jennifer D. Oliva (California College of Law, San Francisco, and Professor Lindsey Simon (Georgia School of Law). The program was moderated by section chair Professor Timothy Daniel Lytton (Georgia State University College of Law).

Speaker, 25th Annual American Bar Association National Class Action Institute

Speaker, "Public Nuisance: The New Sheriff in Town?" Professor Mullenix spoke on the July 2021 New York state amendment of its public nuisance statute to provide a claim against firearms defendants for harms caused to the public through their unreasonable action swith regard to the marketing, manufacture, distribution, and storage  firearms. She also discussed the recent lawsuit filed by Mexico in Masschusetts federal district court suing firearms defendants under publci nuisance theories relating to the trafficking of firearms to drug gangs from the United States into Mexico.

Professor Mullenix was a symposium speaker at the McGeorge School of Law during a program entitled "Blocking the Courthouse Door: Federal Civil Procedure Obstacles to Entry." Her talk was on the topic "Is the Arc of Procedure Bending Towards Injustice?" The program centered on discussion of Professor Michael Vitiello's book, Animating Civil Procedure (Carolina Academic Press 2017). The program brought together leading civil procedure scholars from around the country.  Professor Mullenix's paper will be published in the law review.

Professor Mullenix was an invited speaker and panel participant at the Humphrey Center for Complex Litigation's Roundtable on Multidistrict Litigation. She gave a talk on empowering federal MDL judges to supervise proceedings and settlements through use of the All Writs Act. She participated in panels on "Limits on Judicial Participation in Settlement Discussions and Judicial Approval of Non-Class MDL Settlements;" and a separate panel on "Alternatives to MDL Practice." In this panel discussion, Professor Mullenix discussed developments in transational class action and colective redress mechanisms worldwide. The Roundtable included leading federal and state judges handling MDL and complex litigation; plaintiff and defense attornies; and academic scholars.

Professor Mullenix was a commentator and panelist at the Conference on EU Collective Redress Proejct, at Wolfson College, Oxford University, U.K. on December 12-13, 2016. She discussed issues relating to recent developments in EU countries concerning class action and other collective redress mechanisms. The conference was organized by Professor Chris Hodges of Wolfson College, and Professor Stefaan Voet of the Catholic University of Leuven. The invitation conference convened scholars, attorneys, and government officials from various EU countries, who reported on developments in collective redress in their countries.

Professor Mullenix spoke as a member of the faculty of the 17th annual American Bar Association Class Action Institute, held in Boston, Massachusetts on October 24-25, 2013. She participated in a program panel on emerging issues relating to Article III standing in class action certification, with a focus on so-called "no injury" classes where some class members have yet to experience a manifestation of a product defect. This discussion focused on the "smelly washing machine" litigation being adjudicated in the Sixth and Seventh Circuits. She also spoke on recent decisions from the Third Circuit addressing the problem of defining an "ascertainable class" as a prerequisite to class certification, and the consequences of this doctrine for class action attorneys.

Professor Mullenix was a speaker at the Federal Bar Association's 2013 Annual Meeting and Convention in San Juan, Puerto Rico on September 26-28, 2013. She gave a presentation on developments in private and government-related consumer litigation, including an analysis of the Supreme Court's 2013 decision in FTC v. Actavis concerning the legality of "reverse payment agreements" to generic drug manufacturers. She also spoke about the Court's 2012-13 six class actions decisions and the effects of these decisions on future consumer class actions.

Professor Mullenix participated in the University of Texas School of Law and Oxford University faculty exchange program during May 2013. On May 7th, 2013 she gave the Distinguished Visiting Professor Lecture to the Principles of Civil Procedure class, which included visiting professors from Switzerland and Canada as well as U.S. attorneys. The lecture, entitled “Aggregate Litigation and the Death of Democratic Dispute Resolution,” was based on the article of this title published in 107 Nw. U. L. Rev. 511 (2013) in June 2013. On May 9th she gave a colloquium talk on American class and aggregate litigation at the Oxford Centre for Socio-Legal Studies, under the sponsorship of Prof. Chris Hodges. During her visit to Oxford, Professor Mullenix met with a number of faculty, graduate students, and judges interested in procedure and the resolution of aggregate litigation in the U.K. and civil law countries.

Professor Mullenix was a speaker and a participant in the "Festschrift in Honor of Professor Martin Redish," marking Prof. Redish's 40th year in law teaching. She is a co-author of a treatise on federal courts with Professor Redish. Professor Mullenix spoke on a panel devoted to Prof. Redish's contributions to civil procedure, delivering a paper entitled: "Aggregate Litigation and the Death of Democratic Dispute Resolution." Professor Mullenix was a speaker at a program organized during the March meeting of the Advisory Committee on Civil Rules, in honor of Professor Ed Cooper twenty years of service as the Reporter for the Advisory Committee. The Advisory Committee held its meeting at the University of Michigan Law School. Professor Mullenix spoke about Professor Cooper's efforts during the proposed revision of Rule 23, the class action rule, from 1991 to 1997. Her remarks have been published in a short article entitled: "Professor Ed Cooper: Zen Minimalist," 46 Mich. J. L. Reform 661 (Winter 2013). Among the law professors paying tribute to Professor Cooper, including some former Reporters to the Advisory Committee, were: Steve Burbank (U. Commentator, Faculty Colloquium with Ken Feinberg

Professor Mullenix participated as a commentator in a faculty colloquium featuring Kenneth R. Feinberg, the special master administering the World Trade Center Victims' Compensation Fund, on October 3, 2011, at the law school. Feinberg discussed his work in a presentation entitled, “Unconventional Responses to Unique Catastrophes: Tailoring the Law to Meet the Challenges.” In his talk, Feinberg discussed his career experience, how he approaches his work, and the ethics of putting a “price tag” on a human life. Feinberg was selected by the Obama Administration as Administrator of the Gulf Coast Claims Facility, the $20 billion fund established in the wake of the 2010 British Petroleum Deepwater Horizon oil spill. In 2009, he was appointed Special Master for Troubled Asset Relief Program Executive Compensation, where he determined reasonable compensations for senior corporate officials receiving government bailouts. Feinberg served as Special Master of the September 11th Victim Compensation Fund of 2001 and managed claims for the Virginia Polytechnic Institute’s Hokie Spirit Memorial Fund following the 2007 shooting. Feinberg also orchestrated the Alternative Dispute Resolution Program, which resolved insurance claims arising out of Hurricane Katrina and other hurricanes in the Gulf region for Liberty Mutual Insurance Company and Zurich Insurance Company. He is the author of What is Life Worth? The Unprecedented Effort to Compensate the Victims of 9/11. Professor Mullenix has written extensively about mass tort litigation, the World Trade Center Victim's Compensation Fund, and most recently about the Gulf Coast Claims Facility administered by Mr. Feinberg. Also commenting on Feinberg's presentation was Prof. Dave Robertson. Feinberg's visit to the law school was sponsored by the Center for Global Energy, International Arbitration, and Environmental Law and by the Center for Public Policy Dispute Resolution.

Professor Linda S. Mullenix has been elected as a Fellow of the American Bar Foundation. Fellows are nominated by their peers.” “Selection as a Fellow of the American Bar Foundation is recognition of a lawyer as one whose professional, public and private career has demonstrated outstanding dedication to the welfare of the community, the traditions of the profession and the maintenance and advancement of the objectives of the American Bar Association.” Professor Mullenix was previously elected a Fellow of the Texas Bar Foundation in 2005. Professor Mullenix holds the Morris & Rita Atlas Chair in Advocacy at the University of Texas School of Law. She is a Phi Beta Kappa graduate who earned Masters and Ph.D. degrees in political science at Columbia University, and a J.D. at Georgetown Law School. She teaches federal civil procedure, mass tort litigation, and class actions; and she has taught federal courts and conflicts of law. Professor Mullenix has published ten books and hundreds of articles on complex litigation, federal courts, and civil procedure, including LEADING CASES IN CIVIL PROCEDURE (2010); MASS TORT LITIGATION (2d ed. 2008); and FEDERAL COURTS IN THE 21ST CENTURY (3d ed. 2007). In 2007 she held the Fulbright Senior Distinguished Chair in Law at the University of Trento, Italy. In 2002, she was a scholar-in-residence at the Rockefeller Foundation Bellagio Study Center in Bellagio, Italy. She has been at visiting professor at Harvard Law School and the University of Michigan Law School, as well as a number of other institutions. She is an elected member of the American Law Institute and the International Association of Procedural Law. During 1989-90, she was a Supreme Court Fellow in Washington D.C. She has been a regular columnist for the National Law Journal for twenty years, writing about complex litigation. She has been teaching since 1974.

West Publishing has published Professor Mullenix's book, Leading Cases in Civil Procedure, for use in first year civil procedure courses. The book is intended for the one-semester course in civil procedure, and has integrated relevant constitutional provisions, statutes, and federal rules of civil procedure into the casebook. The book has reduced the number of cases for study, but includes full-text reports of decisions, with all concurring and dissenting opinions.

Milan Conference on Class Action Settlements

Linda Mullenix spoke on American class action settlements at the international Conference on Comparative Collective or Class Action Settlements, sponsored by the Universita degli Studi di Milano, Italy,on September 25-26, 2008. The Conference on Collective Settlements, sponsored by the University of Milan, focused on legislation in 2007 that, for the first time, authorized class action litigation in Italy. Italy is the first nation in the European Union to pass such legislation, a significant development in European law. The conference brought together distinguished legal scholars from Europe and the United States to discuss how group and class actions are implemented in different legal systems. Papers produced for the conference were published by the University of Bologna. In addition to addressing settlements in class action litigation, Professor Mullenix also discussed class actions procedures, potential abuses of settlement classes, due process protections for class members, and the heightened scrutiny of class action settlements in the U.S. after the Class Action Fairness Act of 2005. With a grant from the Rockefeller Foundation, Professor Mullenix was Scholar-in-Residence at the Bellagio Study and Conference Center in Bellagio, Italy, in 2002. She was also the Fulbright Distinguished Senior Chair in Law at the University of Trento, Italy, in 2007, and she has maintained an ongoing relationship with the legal community in Italy. “The class action rule has been in the U.S. since 1938, so we have seventy years of experience,” Mullenix said. “There is no other country that has anything like that length of experience in state and federal courts. For other countries embarking on or formulating class actions there is much to be learned from the American experience, both positive concerning resolving class actions as well as negative in addressing problems and abuses.” Professor Mullenix recently published the second edition of her casebook on Mass Tort Litigation, which was the culmination of twelve years of research, and currently teaches both Mass Tort Litigation and Current Issues in Class Action Litigation at the University of Texas School of Law. Thomson West published the second edition of Professor Mullenix's casebook, Mass Tort Litigation: Cases and Materials. The second edition has been substantially revised to reflect developments in the law since publication of the first edition of the casebook in 1995. The second edition has added the Supreme Court landmark decisions in Amchem Prods. v. Windsor and Ortiz v. Fibreboard, as well as numerous lower federal courts decisions relating to mass tort. Additional sections present materials on punitive damage class actions as well as emerging preemption cases. Professor Mullenix's casebook remains the only casebook on mass tort litigation on the market.

Professor Mullenix published the third edition of Federal Courts in the Twenty-First Century, in August 2007. Her co-authors are Profs. Professor Mullenix was appointed to the Fulbright Senior Distinguished Chair in Law at Trento, Italy during spring 2007. The Fulbright Chair is one of a handful of Senior Distinguished Chairs in the Fulbright program. During her tenure in Italy, she taught a comparative law course on Mass Tort and Class Action Litigation in a Global Context. This course explored class action litigation in the United States, as well as collective and class action litigation in other common law and civil law countries. The University of Trento is a renowned center for the study of comparative law in Europe.

Professor Mullenix served as a faculty member and presented a paper for the Roscoe Pound Institute, 2005 Forum for State Appellate Judges, held in Toronto, Canada on July 22-23, 2005. She presented a paper entitled: "State Rulemaking: The Varieties of the Rulemaking Experience and the Consequence for Substantive and Procedural Fairness." The Roscoe Pound Institute solicited Professor Mullenix to conduct this study of the way in which the fifty states implement rulemaking, as compared to the federal rulemaking model. Professor Mullenix's paper surveys all fifty-state rulemaking models, including state decisional law interpreting rule making statutes and rules. At the Roscoe Pound Institute meeting, Professor Mullenix facilitated a discussion among state appellate law judges concerning the nature and scope of their rulemaking authority. Her paper will be published in the proceedings of the Roscoe Pound Institute. Professor Mullenix has written several articles on the federal rulemaking process.

Professor Mullenix took part in a debate sponsored by the University of Mississippi College of Law and its law review based on the question: "Should Mississippi Adopt a Class Action Rule?" Mississippi is one of only two states in the United States that does not currently have a state class action rule. She was asked by the debate sponsors to argue the negative proposition. Her debate talk was entitled: "Should Mississippi Adopt a Class Action Rule? -- Balancing the Equities: Ten Considerations That Mississippi Ought to Take Into Account in Evaluating Whether to Adopt a State Class Action Rule." She also participated on a panel addressing "The Merits and Demerits of Aggregating Civil Actions." Professor Mullenix's paper will be published as part of a Mississippi Law Review Symposium, "Love It or Leave It: An Examination of the Need For and Structure of a Class Action Rule for Mississippi." The debate symposium took place at the Mississippi State Capitol in Jackson, Mississippi, and was attended by Justices of the Mississippi Supreme Court, the Mississippi rulemaking authorities, numerous Mississippi attorneys, law professors, and students. During her visit to Jackson for the debate, Professor Mullenix was interviewed by the local Mississippi NPR affiliate for her views on the possibility of Mississippi adopting a class action rule.

Professor Mullenix participated as an academic invitee to a conference sponsored by the Committee on the Rules of Practice and Procedure of the Judicial Conference of the United States, Conference on Electronic Discovery, held at Fordham University School of Law, New York City, on February 20-21, 2004. The conference was held in order to elicit comments and suggestions from attorneys, judges, and academics as the Advisory Committee on Civil Rules considers amendments to the existing discovery provisions. Professor Mullenix has written about discovery and discovery abuse in several law review articles.

Professor Mullenix spoke on "The Future of Tort Reform: Possible Lessons from the World Trade Center Victim Compensation Fund," at the Randolph W. Thrower Symposium on "The Future of Tort Reform: Reforming the Remedy, Re-Balancing the Scales." This symposium was held at the Emory Law School in Atlanta, Georgia, on February 19, 2004. Professor Mullenix's paper will be published in the Emory Law Review. She has written on the World Trace Center Victims' Compensation Fund as a possible model for compensation victims of mass tort injury. Professor Mullenix has published the only academic casebook on mass tort litigation: Mass Tort Litigation: Cases and Materials (West Publishing 1995).

Professor Mullenix was a speaker and panelist at the symposium "Cutting Edge Issues in Class Action Litigation," sponsored by the Legal Forum of the University of Chicago Law School on November 1-2, 2002. She spoke on the topic of "The Right to Opt-Out in Class Action Suits," along with panelist Professor Martin Redish of the Northwestern University School of Law. Professor Mullenix addressed the problem of mandatory non-opt class under Rule 23, and the trend towards class action jurisprudence diminishing differences among traditional class categories. Her paper will be published subsequently in the Chicago Legal Forum law review.

Professor Mullenix spoke to the Federal Bar Association of San Antonio on the topic, "The Proposed Amendments to Federal Rule of Civil Procedure 23," on January 16, 2002. Professor Mullenix served on an ABA Task Force on Class Actions during the period between 1991-97 when the Advisory Committee on Civil Rules worked on the first round of amendments to Rule 23. This talk reflected additional work by the Advisory Committee in adding two new section to Rule 23: Rule 23(g) and (h), governing appointment of class counsel and attorney fees.

Roundtable in Honor of Judge Jack B. Weinstein, Brooklyn Law School

Professor Mullenix served as a commentator during a Roundtable program in honor of federal judge Jack B. Weinstein of the Eastern District of New York, sponsored by the Brooklyn Law School. This program was in honor of Judge Weinstein's career, in celebration of his 80th birthday. Judge Weinstein has served as the presiding and managing judge over numerous mass tort litigations, beginning with the Agent Orange settlement in the late 1970s and early 1980s. Professor Mullenix was invited to comment on Judge Weinstein's involvement with mass tort litigation and his contributions to the profession as an activist judge.

This panel topic was part of a Class Action Conference, sponsored by the Committee on the rules of Practice and Procedure of the Judicial Conference of the United States, on October 21-22, 2001, in Chicago, Illinois. The Advisory Committee on Civil Rules has proposed two new additions to the class action rule, Rule 23(g) and (h), to codify principles relating to the appointment of counsel and attorney fees in class actions. Professor Mullenix was invited based on her expertise in American class action litigation, to discuss the American class action for damages and the requirements for pursuing damage class actions in American law.

Professor Mullenix spoke on the topic: "A Good Rulemkaing: Federal Rule 23(f)," at a Symposium on "The New Federal Rules of Civil Procedure: How Will They Affect litigation Strategy and Tactics?," held at the Center for Advocacy and Dispute Resolution at the University of Tennessee College of Law on March 15, 2001, in Knoxville, Tennessee. Professor Mullenix spent two weeks as a scholar-in-residence at the Center, teaching a seminar on the federal rules. Her paper addresses the new provision of the class action rule allowing for interlocutory appeals of class certification decisions. Professor Mullenix's paper will be published in the law review.

Professor Mullenix gave a talk at a faculty colloquium at the University of Tennessee College of Law, entitled "Revising the Class Action Rule -- Federal Rule of Civil Procedure 23," on March 5, 2001. Professor Mullenix discussed the six year process by the Advisory Committee on Civil Rules in revising the class action rule between 1991 - 97. Professor Mullenix served on an ABA Task Force on Class Actions during this period, when she attended meetings of the Advisory Committee as it deliberated on changes to the class action rule. Professor Mullenix commented on both the rulemaking process, as well as the ultimate change to Rule 23, adding a new provision for interlocutory appeal of class certification decisions.

Professor Mullenix attended a meeting of the Ad Hoc Subcommittee on Attorney Conduct, January 2001 invitational, of the Committee on Rules of Practice and Procedure of the Judicial Conference of the United States, held on January 17, 2001, in Washington D.C. Professor Mullenix has published a definitive study of the rules of professional conduct that govern attorney practice in all 94 federal district courts and eleven United States Circuit Courts of Appeal. This is the only study of attorney conduct rules in the federal, as opposed to the state, courts. Her article on federal attorney conduct rules is published in the Georgetown Law Journal.
