    The 13th Screening

    Texas Law ACS will be screening the documentary "The 13th" by director Ava DuVernay. The 13th Amendment to the Constitution reads, “Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States.” The film covers the progression from that second qualifying clause to the horrors of mass criminalization and the sprawling American prison industry.

    Guantánamo: Seeing into the Dark Archive

    Mary Marshall Clark, Director of the Center for Oral History Research at Columbia University, will explore the ethical, legal and constitutional issues that have arisen since the designation of Guantánamo Bay as a site of incarceration and torture for people suspected of terrorism against the United States, following the events of September 11, 2001. In 2008 the Center for Oral History Research at Columbia University developed a large-scale oral history project on the legal, political, ethical and moral consequences of the US sanctioning of this prison. The crisis engendered deep conversations on the consequences of the loss of habeas corpus, the implementation of sustained torture that was visible for the world to see, and the corruption of ethical associations such as the American Psychological Association through its support of government psychologists who contributed to the enhancement of torture techniques, as was revealed in our interviews and later made public by New York Times journalist James Risen. Reflecting on the creation of this ‘dark archive’ made up of over 350 hours of conversation with advocacy lawyers, judges, journalists, psychologists and former prisoners, I will attempt to answer the questions: 1) Why is oral history essential to understanding the disruptions of democracy, as well as its achievements? 2) How can the ‘archive’ represent those who are unseen and unheard, blindfolded from themselves and from us? And what is our role in interpreting the stories we collect and share? 3) What are the implications of constructing an archive on torture, in the country that has legitimized it?

    WLC's Fundraiser for SAFE Alliance

    March 8th is international Women's Day! Celebrate with Women's Law Caucus by donating to victims of domestic violence and sexual assault. We will be collecting donations of tampons, pads, and other hygiene products such as shampoo, conditioner, shaving supplies, and diapers in the atrium on March 8th from 10am to 3pm. We will also accept monetary donations. All donations will be given to Austin's SAFE.

    SAFE is a merger of Austin Children's Shelter and SafePlace, dedicated to ending child abuse, sexual assault, and domestic violence. It provides housing, healing, and support for individuals and families affected by domestic violence, and sexual assault and exploitation through prevention and intervention services. In addition, the organization promotes safe and healthy relationships, increasing the capacity for abuse prevention in Central Texas.

    The Slants: In Concert and Conversation

    Managing Space Traffic: Dr. Howard

    On Monday, March 19, 2018, the Robert Strauss Center welcomes Dr. Diane Howard, Assistant Professor of Commercial Space Operations at Embry-Riddle Aeronautical University, for a discussion on the law, security, and technology policy issues arising from steadily increasing space traffic. This talk, free and open to the public, will take place at the Texas Law School in the Sheffield-Massey Room, TNH 2.111.

    Dr. Diane Howard is Assistant Professor in the Commercial Space Operations program at Embry-Riddle Aeronautical University in Daytona Beach, Florida USA. She is responsible for curriculum development and teaching space law and policy courses that are core to the program. Diane first became involved in space initiatives in 2004, participating in citizen lobbying efforts to facilitate the passing of the Commercial Space Law Amendments Act of 2004, a critical piece of US legislation that has made possible the development of innovative technologies and a burgeoning commercial space transportation industry.

    Dr. Howard has retained her interest in commercial space issues. After working as a staff attorney in the Florida Appellate courts for a number of years, she took the decision to specialize in space law and attended McGill University’s Institute of Air and Space Law. Her LLM thesis centered upon private space law issues and her doctoral work focused upon effective spaceport regulation.

    Diane serves as Executive Secretary of the International Institute of Space Law and participates in numerous legal projects, both domestically (within the US) and internationally. She works with COMSTAC Working Groups when invited. The US Department of State named her a private sector advisor and subject matter expert in Expert Group D of the UN COPUOS STSC Long Term Sustainability of Space Activities Working Group, hoping to soon conclude its work. Dr. Howard was legal lead for the International Association for the Advancement of Space Safety Suborbital Safety (IAASS) Technical Committee, which recently finalized its guidelines. She continues to publish her research and speaks at space conferences and events throughout the world. In addition to the IISL and the IAASS, Diane is a member of the AIAA and the Florida Bar.

    Diversity and Inclusion in the Legal Profession: ABA Findings on LGBT+ Lawyers and Lawyers with Disabilities

    Join us for a talk followed by discussion with Peter Blanck, chairman of the Burton Blatt Institute at Syracuse University.

    In 2017, the American Bar Association launched a first-of-its kind nationwide longitudinal study, conducted by the Burton Blatt Institute, to identify biases encountered by disabled and LGBT+ lawyers in the legal profession, and to help develop and implement strategies to ameliorate such biases. This talk presents preliminary findings from this national study, based on responses from 1,000 lawyers across the United States. The initial findings suggest the need for continuing efforts to promote the full and equal participation of all diverse persons, including lawyers with disabilities and who are LGBT+, in the legal profession.

    Human Rights and the Chagos Islanders

    In 1965, three years before Mauritius achieved independence, the British separated the Chagos Islands, an archipelago in the Indian Ocean, from the rest of its colony. Mauritius claims this separation was in breach of UN resolution 1514, passed in 1960, which banned the breakup of colonies before independence. A few years later, the British forcibly removed the inhabitants of the Chagos Archipelago from their homeland to make way for construction of a U.S. military base on the island of Diego Garcia.

    The Chagossians have been engaged in litigation for decades over proper compensation for their removal as well as the right to return to the islands. Their cases have been heard in sites including British and U.S. courts, the European Court of Human Rights, and the Permanent Court of Arbitration. In 2017, the UN General Assembly voted to request an advisory opinion from the International Court of Justice (ICJ). The ICJ will review core questions of sovereignty (both the UK and Mauritius claim the islands as their own), as well as wider issues of decolonization and the exercise of the right to self-determination.

    Robin Mardemootoo, who holds an LLM from Texas Law, will speak about his involvement in the Chagos Island case. He has litigated in the UK, the US, and now before the ICJ. He is coordinating the crossborder litigation.

    The Spring Pledge Drive is Texas Law Fellowships's biggest fundraising event. During this week of March, TLF raises money from around the UT community to help fund and award TLF fellowships to Texas Law students. Students donate so their peers can work in public service over summer. Alumni, faculty, and staff pitch in as well with donations and class incentives. Many law firms match student donations. During Pledge Drive, anyone who donates over $30 during Pledge Drive can vote for fellowship candidates. Pledge Drive is also your best chance to get TLF merchandise!
