The Supreme Court's emergency docket—often called the "shadow docket"—has put the Court between a rock and a hard place. In ruling on an emergency application, the Court can either write nothing and leave its decision unexplained, or it can write an opinion and lock its underdeveloped views in as binding precedent. Tyler Dobbs (Consovoy McCarthy) joins us to explore how a procedure already used by lower courts could offer the Court a solution, bringing clarity and accountability to one of the Court's most controversial practices.

Gates Global Policy Center, and the Strauss Center for International Security and Law will host “Beyond the Battlefield: Influence, Incentive, and Coercion in the New Era of Great Power Competition,” the sixth installment of our Texas National Security Forum. After a five-year hiatus, this signature conference returns to Austin, convening top voices from government, academia, and the private sector to examine how the instruments of national power are evolving in a new strategic era.

We are excited to host the Honorable Robert M. Gates, former Secretary of Defense and Director of Central Intelligence, for a keynote conversation with Will Inboden, Executive Vice President and Provost of the University of Texas at Austin. We are also featuring General (Ret.) Vince Brooks, U.S. Army, General (Ret.) Peter W. Chiarelli, U.S. Army, General (Ret.) Robert Neller, U.S. Marine Corps, and General (Ret.) In an era of renewed great power competition, the tools of influence extend far beyond the battlefield. This conference will explore how diplomacy, economic statecraft, intelligence, emerging technologies, and historical lessons inform the United States’ ability to shape the global environment without overreliance on military force. As current and future leaders confront rising global challenges, these tools are more critical than ever to protecting American interests and sustaining leadership. Through a series of focused panels, a keynote address from Robert Gates, and a keynote conversation with senior military leaders, we will examine how all instruments of national power must be integrated into a comprehensive strategy to sustain American leadership and counter rival powers. On Monday, November 17, the Strauss Center, Center for European Studies, and Strauss-Clements’ Intelligence Studies Project will host “Between Stars and Shadows: Intelligence Oversight in the Low Countries.” We will be joined by Hugo Hillenaar, the Chairman of the Dutch Review Committee on the Intelligence and Security Services (CTIVD), Philippe Meert, a member of the Investigation Department of the Belgian Intelligence Oversight Committee, and Martin Dethier, legal adviser for the Belgian Intelligence Oversight Committee. The discussion will be moderated by Dr. Michael Mosser, Director of the Center for European Studies.

While national security remains the sole responsibility of the Member States of the European Union (EU), intelligence activities increasingly intersect with EU law and institutions. Legal frameworks from both the EU and the Council of Europe influence how intelligence agencies operate, particularly in the field of data protection and privacy. This presentation provides an overview of the state of intelligence and its oversight in the EU. The specific situations of Belgium and the Netherlands are then examined from both a legal and practical perspective.

This virtual panel will feature organizers and members of a transnational research collective that convenes graduate researchers based in South Africa and the United States whose research critically examines the distributional consequences of the laws, policies, development programs, and technological innovations that entail the “green” transition. The collective is organized by the Southern Centre for Inequality Studies (SCIS) at the University of the Witwatersrand in Johannesburg and the Rapoport Center for Human Rights and Justice at the University of Texas at Austin. Members meet monthly to discuss cutting edge research, hear from leading scholars in the field, and workshop each other’s scholarship. Panelists from both institutions, including some of the participating researchers, will reflect on the substantive questions examined through this collective, while considering the lessons learned from convening graduate researchers across borders and scholarly disciplines.

What Is Use and What Is Abuse of an Insolvency Proceeding? An Inquiry from Europe.

Christoph Paulus is Professor Emeritus of Law at Humboldt University in Berlin, where he taught from 1994 to 2019, serving as Dean of the Law Faculty from 2008 to 2010. A graduate of the University of Munich (Dr. iur., Habilitation) and UC Berkeley (LL.M.), he has served as consultant to the IMF, World Bank, and the European Commission, and advised Germany’s delegation to UNCITRAL. He is Associate Member of South Square (London) and Of Counsel at White & Case (Berlin). Widely recognized in the field of insolvency law, he is a member of numerous international legal institutes, has held guest professorships on five continents, and received an honorary doctorate from Aristotle University in Thessaloniki.

In his lecture, Professor Paulus explores the boundaries of insolvency law by examining high-profile cases such as Johnson & Johnson and Purdue Pharma. Using these as a springboard, he reflects on the fundamental purpose of insolvency law and considers how it should be applied in practice. Along the way, he revisits the age-old debate captured by the Roman jurists in the concept of in fraudem legis - a framework that resonates strongly with today’s pressing question of where legitimate use ends and abuse begins.
