Description
This seminar will focus on selected issues arising in the enforcement of intellectual property involving patents through litigation in federal and state courts and administrative tribunals. Specific issues to be considered include: the use of alternative dispute resolution; pre-litigation strategy; investigation and initiation of a suit; procedural considerations for forum and party selection; design and execution of discovery programs; pre-trial considerations including the use of summary judgment; and trial before the court or a jury involving complex technologies. Other issues to be discussed include evaluation of the strengths and weaknesses of intellectual property involved in the litigation; business objectives concerning enforcement of the intellectual property; and antitrust considerations bearing upon enforcement of the intellectual property.Instructors
