Texas Marital Relations and Divorce

This course surveys Texas law on marriage and divorce. The marriage component focuses on who can marry, who cannot marry, informal (or common law) marriages, putative marriages, pre-marital and marital agreements and the various tax issues related to marriage and divorce. The divorce component focuses on the characterization of property (as community, separate or otherwise), reimbursement and other inter-spousal claims, homestead laws, management of property, the rights and limitations of third persons in dealing with a spouse's property, and division and confirmation of community and separate property upon death and divorce. Students participate in a final project over a 5-day period at the end of the semester wherein they analyze and work through a divorcing couple's set of issues, which may be done either alone, or with a partner, and which (at the students' election) may involve a negotiation process wherein the students work towards a final or proposed settlement.
