Oral arguments in USA v. State of Arizona will be heard by a panel of three judges of the United States Court of Appeals for the Ninth Circuit. The Law School will broadcast this event beginning at 11:00 a.m. in the Francis Auditorium.

Next Monday we will have a rare opportunity to watch the Ninth Circuit in action.

Oral arguments in USA v. State of Arizona will be heard by a panel of three judges of the United States Court of Appeals for the Ninth Circuit on Monday, November 1, 2010. The panel has given consent for live broadcast of the proceeding and the School of Law will make this broadcast available in the Francis Auditorium, beginning at 11:00 a.m.

The case involves the constitutionality of Arizona Senate Bill 1070, which requires state law enforcement officers to check a person’s immigration status under certain circumstances, and authorizes a warrantless arrest where there is probable cause to believe that the person has committed an offense making him or her removable from the United States. The U.S. Government, arguing that SB 1070 was preempted by federal statutes, sought a preliminary injunction to block enactment of the law. The preliminary injunction was granted in part and denied in part by the U.S. District Court for the District of Arizona. The State of Arizona and its governor have appealed, seeking to remove the injunction imposed by the district court on certain portions of SB 1070.

The Ninth Circuit has posted all the briefs, including numerous amici curiae briefs, on the USA v. State of Arizona, No. 10-16645 page on their web site.

Oral arguments are expected to last approximately one hour. Pizza will be served in the Francis Auditorium.

The Drawing Board Luncheon is a regular colloquium series designed to permit members of the UT faculty (permanent and visiting) to present projects at an early stage of development. Unlike many colloquia series, here and elsewhere, that are often described as fora for the presentation of "works in progress" but which, in actuality, feature works that are entirely, or substantially, complete, the Drawing Board lives up to its name. This is a forum for faculty members who would like feedback, suggestions, and guidance at a point in time at which they can be made use of.

Dan Rodriguez will give a talk on Wednesday sponsored by the American Constitution Society. This event is open to the public. Rodriguez will discuss the gay marriage litigation of the last decade, touching on both the constitutional issues it raises and the strategic choices the gay rights movement has made in its litigation efforts. He will conclude with a preview of potential outcomes of the pending Proposition 8 case from California. This talk will be from 11:30 a.m. to 12:30 p.m. in the Eidman Courtroom.

On Thursday, Nov. 4 at 11:30 in the Eidman Jury Room, Prof. Julius Getman will be speaking about his new book on unions in America. The labor movement is weak and divided. Some think that it is dying. But Prof. Getman demonstrates through examination of recent developments that a resurgent labor movement is possible. He proposes new models for organizing and innovating techniques to strengthen the strike weapon. Above all, he insists that unions must return to their historical roots as a social movement.

New technology has revolutionized how we all live. Technology can also pose risks to customers' privacy and freedom of expression. Failing to take these rights into account can easily lead to negative press, costly lawsuits and government investigations. That's why the ACLU of Northern California has developed 'Privacy and Free Speech: It's Good for Business,' a primer designed to help free speech protections in new technology.

On Friday, November 19, 2010 The University of Texas School of Law, in cooperation with the American Bar Association's Criminal Justice Section, will host a one-day roundtable addressing the Criminal Justice Section’s current project of revising its Standards concerning the Prosecution and Defense Functions. Invited participants, consisting of respected prosecutors, defense attorneys, and judges from across the State of Texas, and academics in the fields of criminal justice and professional responsibility, will engage in a series of moderated discussions on whether the proposed revisions provide adequate and appropriate guidance to prosecutors and defense lawyers, focusing on ethical issues surrounding case loads, conflicts of interest, and prosecutor discretion in initiating and maintaining criminal charges. The day’s proceedings will be reported and circulated to the Standards Revision Task Force to provide concrete guidance from criminal justice stakeholders in the Standards revision process.

The Prosecution and Defense Functions Standards are just two of the Criminal Justice Section’s Standards documents, which set forth aspirational goals for a variety of arenas of the criminal justice system, including Criminal Appeals, Discovery, DNA Evidence, the Legal Status of Prisoners, Mental Health, and Speedy Trial. The Standards in general, and the Prosecution and Defense Functions Standards in particular, have been widely influential since their initial promulgation in 1974, when Chief Justice Warren Burger hailed the Standards project as "the single most comprehensive and probably the most monumental undertaking in the field of criminal justice ever attempted by the American legal profession in our national history." Hundreds of Supreme Court and lower court opinions have cited the Standards as persuasive authority, legislatures have looked to the Standards in enacting state codes of criminal procedure and other criminal justice reforms, courts have adopted the Standards in their local rules, and prosecutor and defense offices have incorporated the Standards into local office policies.

The current revision process will culminate in the publication of the third edition of the Prosecution and Defense Functions Standards, which were last revised in 1992 and 1991, respectively. The University of Texas School of Law is honored to play a small part in that important endeavor by hosting this series of conversations among the leading players in Texas criminal justice.

Reminder for 3Ls planning to sit for the Texas July 2011 Bar Exam: your In-State Application to Take the TX Bar Exam may be timely filed with the Texas Board of Law Examiners (BLE) between today and January 30, 2011. This deadline is strictly enforced. A $150 late fee will apply for all applications filed after January 30 and up to the March 30, 2011 Absolute Postmark Deadline.

Applicants who have not yet filed their Declaration of Intention to Study Law must do so prior to or with their In-State Application.
