    Texas Transactional Skills Competition

    During the Fall, the Texas Business Law Society (TBLS) hosts the Texas Transactional Skills Competition, where 1Ls and 2Ls gain valuable experience cultivating their drafting and negotiating skills, testing those skills against fellow law students in competition rounds.     Colloquium on Complex Litigation

    "Politics, Identity, and Class Certification on the U.S. Courts of Appeals" (with Stephen B. Burbank)

    ABSTRACT

    This article draws on novel data and presents the results of the first empirical analysis of how potentially salient characteristics of Court of Appeals judges influence precedential lawmaking on class certification under Rule 23. We find that the partisan composition of the panel (measured by the party of the appointing president) has a very strong association with certification outcomes, with all-Democratic panels having more than double the certification rate of all-Republican panels in precedential cases. We also find that the presence of one African American on a panel, and the presence of two females (but not one), is associated with pro-certification outcomes. Contrary to conventional wisdom in the scholarship on diversity on the bench, such diversity may be consequential to lawmaking beyond policy areas conventionally thought to be of particular concern to women and racial minorities.

    Class action doctrine is a form of trans-substantive procedural law that traverses many policy areas. The effects of gender and racial diversity on the bench, through making more procertification law, radiate widely across the legal landscape, influencing implementation of consumer, securities, labor and employment, antitrust, prisoner’s rights, public benefits, and many other areas of law. The results highlight how the consequences of diversity extend beyond conceptions of “women’s issues” or “minority issues.” The results also suggest the importance of exploring the effects of diversity on trans-substantive procedural law more generally.

    Doing Well and Doing Good

    Large law firms continue to increase their pro bono commitments, delivering more than 5 million hours of free legal services annually, while profits and revenue continue to grow as well. How is this possible? Steven Schulman, Pro Bono Partner at Akin Gump, argues that the culture, structure and economics of large firms is uniquely situated to allow pro bono to thrive. Steven has been the Pro Bono Partner for Akin Gump Strauss Hauer & Feld since 2006. He manages the firm’s world-wide pro bono practice, which devotes more than 100,000 hours annually to a range of clients, from non-profit organizations to individuals in need of protection. Steven got his start in pro bono work by representing a Nigerian family in immigration court in 1998, and has worked on human rights and refugee matters ever since. For more than a decade, he has taught courses on law firm economics and the public interest at the law schools at Georgetown, Stanford and University of Southern California. He is also an obsessive baseball fan, and the creator of the erstwhile pitching statistic Runs Prevented.

    Screening of "The Penalty" a documentary on capital punishment followed by a Q and A with the filmmakers.

    The Penalty is a feature documentary film following three people with extraordinary experiences of America's modern death penalty and goes behind the scenes of capital punishment's most recent headlines. The film is directed by Will Francome (In Prison My Whole Life, Sundance 2008) and Mark Pizzey (who together Raindance Award Winner One For Ten), and edited by James Scott (Sundance Special Jury Award for Editing award 2015 for How to Change the World).

    Supreme Court Debrief, LGBTQ Protections

    Earlier this month, the Supreme Court heard oral argument on whether Title VII of the Civil Rights Act covers sexuality and gender identification. Title VII, as you probably know, prohibits employment discrimination based on race, color, religion, national origin, and gender. However, there are currently no federal employment protections for sexuality and gender identification. ACS, OUTLaw, and PILA are excited to present a SCOTUS Debrief on the cases that are challenging whether or not Title VII should protect sexuality and gender identification. Professor Elizabeth Sepper will lead a discussion about the cases' histories, the oral argument at the Supreme Court, and then will open the floor for questions. Lunch will be provided.
