Rights of Transgender Persons in Texas (2020)

The Human Rights Clinic collaborated with the Austin Community Law Center and Trans Pride Initiative to address the harms that transgender incarcerated people face within the Texas Department of Criminal Justice.  Texas Family Code 45.103 restricts the ability of incarcerated persons from changing their name. The Clinic sent surveys to 300+ transgender incarcerated persons to gather data on the harm that this code causes. The surveys compiled extensive personal testimony detailing the feelings of mental harm and gender dysphoria transgender incarcerated persons suffer daily. The Clinic and its partners wrote a report describing how the current Code harms and violates the human rights of transgender incarcerated persons, and made recommendations calling for Texas to comply with international human rights law by repealing or amending this Code.
